Rule 5
Creation of special posts
: (1) Special posts can be created in the following cases:-
(a) If a civil servant is delayed in reaching the office to which he has been transferred due to circumstances beyond his control,
(b) If a civil servant is not appointed to perform the duties of his former office,
(c) If any civil servant is engaged in training, scholarship, seminar etc.,
(d) If a civil servant takes leave for more than one month,
(e) Section 7A of the Act. According to sub-section (3) of , if the vacant position is requested and sent, if such position is not vacant and the employee is recommended by the Public Service Commission.
(2) When creating a special position according to sub-rule (1), a decision must be taken from the secretary level of the relevant ministry, commission or secretariat in the case of a gazetted position, and from the relevant departmental head level in the case of a gazetted position, with the consent of the Ministry of General Administration. But in the case of Clause (a), (c) and (e) of sub-rule (1), if a special post is to be created for a period of less than one month, the consent of the Ministry of General Administration is not required.
(3) If the condition of sub-rule (1) does not exist, the special post so created shall automatically be cancelled.
